Your funds. Our responsibility.
A 1031 Exchange asks you to hand over the full sales proceeds to your Qualified Intermediary. Here's exactly how we protect it.
Unlike banks or title companies, Qualified Intermediaries ("QI") are not regulated by a federal agency, and only a small number of states require QIs to be licensed or bonded. The level of protection you get depends entirely on the QI you choose. Here is exactly what we do to safeguard your funds, in plain terms.
How your exchange funds are held
Your Exchange Proceeds are held at an FDIC insured bank, in a trust account, separate from Tidemark's own operating funds. Funds are never commingled with company accounts, and you will receive a ledger showing the inflow and outflow of your money.
Disbursement controls
Release of your funds requires a signed settlement statement or your separate written approval. Your funds are disbursed only to acquire your identified Replacement Property or to you.
Experience you can verify
In business as a Qualified Intermediary since 2004, founder John Bartley brings 30 years of real estate title and closing experience. Direct, one-on-one handling of your exchange — not a call center.
Insurance
We carry an Errors and Omissions Insurance policy with $1,000,000.00 of coverage.
